Every item offered for sale on this site is a pre-owned, secondary-market piece and is sold strictly AS-IS, WHERE-IS, WITH ALL FAULTS, with no warranty of any kind, express or implied. This includes — without limitation — disclaimers of any implied warranty of merchantability, fitness for a particular purpose, condition, quality, or non-infringement.
We make a good-faith effort to photograph each piece thoroughly and to describe any condition issues we observe. Photographs and written notes are intended to help you assess the item for yourself prior to purchase. Color, texture, sheen, framing, and minor wear may appear differently in person than on a screen. It is the buyer's responsibility to review all photographs and descriptions and to ask any questions before completing a purchase.
Because every piece is sold as-is, we do not offer refunds, returns, or exchanges based on the condition of an item not meeting a buyer's expectations. This includes — without limitation — variations in color, finish, framing, matting, signs of age, prior restoration, minor surface marks, or any condition issue that was reasonably observable in the listing photographs or noted in the description.

We carefully pack every item and fully insure each shipment for its purchase price. In the unlikely event a piece is damaged in transit:
Second Hand Gallery makes no independent representation, warranty, or guarantee regarding the authenticity, attribution, provenance, edition, or chain of title of any piece offered for sale.
Where we believe — based on documentation, certificates, gallery markings, stamps, signatures, or other indicia accompanying a piece — that a work originated from Park West Gallery or another specific publisher, gallery, or artist, we will state that belief and describe the basis for it. Any such statement is our good-faith opinion only and is not a guarantee of authenticity, attribution, or chain of title.
Second Hand Gallery shall not be held liable for any claim, loss, or damages arising out of an allegation that a piece is not authentic, is misattributed, or has a defective provenance. Buyers who require certainty as to authenticity should obtain an independent authentication or appraisal prior to purchase.
Listed prices reflect what Second Hand Gallery is willing to accept for a piece on the secondary market and do not constitute an appraisal, valuation, or statement of fair market value, replacement value, or investment value.
Any reference to an original retail price, prior appraised value, or publisher's price is provided for historical context only and is not a representation of current market value.
Second Hand Gallery shall not be held liable if a piece, when subsequently appraised by an independent appraiser, does not appraise at or above the purchase price. Art is not a guaranteed investment, and secondary- market values fluctuate.
We do not use stock, catalog, publisher, or press photography anywhere on this website. Every image shown on this site — on listings, artist pages, category pages, and the homepage — is a photograph of the actual physical piece that Second Hand Gallery obtained in person, photographed in our own possession, and uploaded here for the purpose of that resale listing.
What you see is the exact item you receive: the same frame, the same edition, the same condition. We never substitute a representative or promotional image of another copy of the same work, and we never reuse imagery belonging to another gallery, publisher, artist, or estate.
Dimensions, edition numbers, signatures, and other specifications are provided in good faith based on the piece itself and any accompanying documentation. We do not guarantee the accuracy of any specification and recommend that buyers independently verify any detail that is material to their purchase decision.
To the maximum extent permitted by law, Second Hand Gallery's total aggregate liability to any buyer for any claim arising out of or relating to a purchase — whether in contract, tort, warranty, or otherwise — shall not exceed the purchase price actually paid for the piece giving rise to the claim. In no event shall Second Hand Gallery be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost value, or diminution in value.
By placing an order, you acknowledge that you have read, understood, and agreed to these Terms & Disclaimers, and that you are purchasing each piece in reliance on your own inspection and judgment and not on any statement, representation, or opinion of Second Hand Gallery.
These terms and any sale made through Second Hand Gallery shall be governed by the laws of the jurisdiction in which Second Hand Gallery is operated, without regard to its conflict-of-laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in that jurisdiction.
Second Hand Gallery may update these Terms & Disclaimers at any time. The version in effect at the time of your order governs that order.
